The Governor has just signed a law requiring training of current and new police officers to enforce Article 26 of the New York State Agriculture and Markets Law.

AN ACT to amend the executive law, in relation to the duties of the
municipal police training council

The People of the State of New York, represented in Senate and Assem-
bly, do enact as follows:

1 Section 1. Subdivision 1 of section 840 of the executive law is
2 amended by adding two new paragraphs (k) and (m) to read as follows:
3 (k) Development, maintenance and dissemination of written policies and
4 procedures pursuant to article twenty-six of the agriculture and markets
5 law, section 352.3 of the family court act as it applies to companion
6 animals, and applicable provisions of the penal law, regarding the
7 investigation and prevention of any act of cruelty to animals.
8 (m) Establishment and implementation on an ongoing basis, of a train-
9 ing program for all current and new police officers and peace officers
10 regarding the policies and procedures established pursuant to paragraph
11 (k) of this subdivision.
12 ยง 2. This act shall take effect immediately.

TITLE OF BILL: An act to amend the executive law, in relation to the
duties of the municipal police training council


PURPOSE OR GENERAL IDEA OF BILL: To authorize the Municipal Police
Training Council to recommend to the governor rules and regulations with
respect to the development of policies and procedures regarding the
investigation, enforcement, and prevention of any act of cruelty to
animals and to provide training to law enforcement on such policies and
procedures.


SUMMARY OF SPECIFIC PROVISIONS: This bill amends the executive law by
adding two new paragraphs (k) and (m) to subdivision 1 of section 840.

Paragraph (k) authorizes the Municipal Police Training Council to recom-
mend to the governor rules and regulations with respect to the develop-
ment, maintenance, and dissemination of written policies and procedures
for the identification and enforcement of animal cruelty laws pursuant
to article twenty-six of the agriculture and markets law, any applicable
sections of the penal law, and section 352.3 of the family court act as
it applies to orders of protection for companion animals.

Paragraph (m) establishes that above-mentioned policies and procedures
on the investigation and enforcement of any act of cruelty to animals be
included in ongoing training of members of law enforcement.


JUSTIFICATION: Currently the Municipal Police Training Council may
recommend to the governor rules and regulations with respect to basic
training and the development and dissemination of written policies and
procedures, and training on such procedures, regarding the investigation
and intervention of family offenses as well as child abuse and neglect
cases. This bill would include the development and dissemination of
policies and procedures, and training on such procedures, regarding the
investigation and prevention of animal cruelty cases. Such education
and training would create a more effective means of investigating and
preventing acts of cruelty to animals.


PRIOR LEGISLATIVE HISTORY: none


FISCAL IMPLICATIONS: None


EFFECTIVE DATE: This act shall take effect immediately.

It will be interesting to see how this unfolds over time.....

Agree! I hope it will have a positive impact..

It was timely ... a board member sent this to me tonight and I saw it when I got home from a call about a dog being hit by car this afternoon. Woman called had witnessed the hit by car.. dog was in pain and the owner of the dog could not take to the vet they said because of no $$ of course... :cuss:

So, lady witness calls the local PD...she tells me PD told her "what do you want us to do about it?? its not against the law to not take your <injured> dog to vet" :cuss: so she starts in the phone book looking for who to call and get the dog some help...

sad to say that is not the first time I've been told that has happened in our county..

Long story short we went and took a look at the dog and he is sore on one foot but not limping now, very happy golden mix...scared the young owners to death.. young man was ready to cry telling us about it, car knicked the dog and the dog freaked and ran all over screaming for a few moments.. and OF COURSE there is a leash law and the dipchit was too lazy to put the leash on him to take him pee! saw people across the street.. gonna say hi and dogs don't look both ways first...stupid people.

As it ends up.. its the same young couple I saw last year at different address with a different dog that was injured and had to serve notice to them with the same PD to take the dog to the vet.. they did and never paid the bill.. :cuss: asked where that dog was now and they told us she was hit by car this summer and died...
